The present conditions aim to define the terms of sale between BASIL DKR and the user, from the order to the services, including payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.
Any order implies acceptance of the prices and descriptions of the products available for sale, as well as the general terms and conditions of sale. Any dispute on this point will intervene within the framework of a possible exchange and guarantees mentioned below.
BASIL DKR undertakes to honor orders received on the website only within the limits of available stocks of products. If the product is not available, BASIL DKR undertakes to inform the user.
Shipping costs are the responsibility of the user and depend on the delivery country. They will be specified to the customer upon order confirmation.
Delivery in mainland France and Belgium to a pickup point is free of charge.

Ordered products will be delivered to the address indicated by the user.
Orders placed before 12:00 PM are prepared and shipped on the same day the order is placed. Orders placed after 12:00 PM will be shipped the next day.*

Delivery times start from this date. Unless there are special operations, they will be, within available stock, from 24h to 72h for France, and around 3 working days for foreign countries depending on the destination and the chosen delivery method.

For deliveries outside the European Union, we strive to facilitate customs clearance with our delivery provider as much as possible to avoid delaying your delivery. In some cases, however, the delivery time may be extended due to customs checks, which are beyond our control.
All our deliveries are handed over against signature except during lockdown periods or contrary instructions from our providers. BASIL DKR does not deliver to P.O. boxes.
In case of absence, a delivery notice should be left in the recipient’s mailbox. The customer has 15 days to pick it up at their post office.
At any time, you have the option to track your package on the websites of Chronopost, La Poste, and DHL.
In case of delay, BASIL DKR cannot be held liable for any reason whatsoever. Consequently, no compensation claim of any kind can be made by the user against BASIL DKR.
Note: For any delivery outside the European Union, additional customs fees and taxes may apply. This information will be indicated during the finalization steps of your order.
Prices are indicated in euros, including all taxes, except for countries outside the European Union. These prices do not include handling fees (shipping, packaging, and preparation of the package according to the applicable rates). Any change in the applicable rate may be reflected in the product prices. After this date, they may be modified at any time. However, prices cannot be changed once the customer’s order has been placed. Similarly, if one or more taxes or contributions are created or modified, whether increased or decreased, this change may be reflected in the sale price of the items on the BASIL DKR website.
The prices indicated on the site are guaranteed for the duration of the online posting and within the limits of available stock.
The final price billed to the customer is the price indicated on the order confirmation.
Payment is made by credit card bearing the Visa, Eurocard, Mastercard, or American Express logo. You can also pay via PayPal. Your bank account will be debited upon order confirmation. Knowing that there is always a delay from the banks, payment validation may sometimes take a day from the order confirmation. The product invoice will be included in the package containing the ordered product.
All items from the current collection that are not on sale can be exchanged (subject to stock availability) or refunded. Sale items or end-of-line products can only be refunded.
In France, returns are free via Colissimo and at the pop-up store within fourteen working days from the date of receipt or collection of the package.
Customer returns can also be made by mail to the address below within fourteen working days from the date of receipt or collection of the package. Products must be returned by mail in perfect condition with the invoice to the following address:

The right of withdrawal can be exercised either directly by going to “My Order” or “My Account”, or by using and sending the withdrawal form included in Annex 1 of the General Terms and Conditions of Sale, by mail to the following address: BASIL – Service Returns BASIL DKR – 74, Rue Vieille du Temple – 75003 PARIS, France, or by email to contact@basildkr.com.
The Customer cannot exercise the right of withdrawal for a Product made to their specifications, used, worn, washed, damaged, or unsealed.
It is the user’s responsibility to keep any proof and date of this return. If it is an exchange, the new shipping costs will not be charged to the customer. Refunds will be processed within 10 working days following receipt of the package.
Attention, for returns from outside the EU, please make sure to clearly state on the customs form that it is a “return” to ensure the return is processed with “duty and tax exemption” (without additional fees), and also include the original invoices in the return package specifying which items are being returned.
All items are covered by a contractual warranty, which does not affect the legal warranty provided by Articles 1641 and following of the Civil Code. The user also benefits from a warranty allowing them to return defective delivered items in accordance with Articles L 211-4 and following of the Consumer Code. Users are therefore invited to refer to these texts for more details on these legal warranties.
Any disputes concerning a sale concluded under the general terms and conditions of sale, including issues related to validity, interpretation, execution, termination, consequences, or any unresolved matters between the seller and the customer, may be brought before the competent courts under common law conditions.
In case of a dispute, the Customer is informed that they can, in any case, seek conventional mediation to find an amicable solution before taking any legal action, notably through the Consumer Mediation Commission (Consumer Code, Art. L 612-1) or through existing sectoral mediation bodies, with references available on the website www.cm2c.net.
Claims: Upon receipt of the items, the customer must immediately check the condition and conformity of the items against the order, including the quality, quantity, and characteristics of the items. If the items do not conform to the order or are damaged, the customer must make reservations and claims with the carrier or refuse the delivery if the package is opened or damaged, and send their claims by email to contact@basildkr.com within 15 (fifteen) days of delivery. The customer must then specify and justify in detail the reasons for the claim. No claim will be considered if the use of the items is deemed disproportionate. No spontaneous returns, without BASIL DKR’s agreement, will be accepted, except in the case of exercising the right of withdrawal.
Legal Warranty: The items sold are also covered by the legal warranty of conformity provided for in Articles L. 217-4 to L. 217-13 of the Consumer Code and by the warranty relating to hidden defects of the item sold, under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code. According to the provisions of Article L. 217-15 of the Consumer Code, Articles L. 217-4, L. 217-5, and L. 217-12 of the Consumer Code, as well as Article 1641 and the first paragraph of Article 1648 of the Civil Code, are reproduced below.
Article L. 217-4 of the Consumer Code
“The seller is required to deliver a good that is in conformity with the contract and is liable for defects in conformity existing at the time of delivery.
The seller is also liable for defects in conformity resulting from the packaging, assembly instructions, or installation when the latter has been made the seller’s responsibility by the contract or has been carried out under the seller’s responsibility.”
Article L. 217-5 of the Consumer Code
The good is in conformity with the contract if:
1° It is suitable for the usual use expected of a similar good and, where applicable:
– it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;
– it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° Or it has the characteristics agreed upon by the parties or is suitable for any special use sought by the buyer, which was brought to the seller’s attention and accepted by them.
Article L. 217-12 of the Consumer Code
“The action resulting from a lack of conformity is subject to a two-year statute of limitations from the delivery of the good.”
Article 1641 of the Civil Code
“The seller is liable for the warranty regarding hidden defects of the sold item that render it unfit for the intended use or significantly diminish the use of the item, which the buyer would not have purchased or would have paid a lower price for if they had known about the defects.”
Article 1648 paragraph 1 of the Civil Code
“The action resulting from hidden defects must be initiated by the buyer within two years from the discovery of the defect.”
Except for the cases provided for in these T&Cs, the items sold are neither returned nor exchanged.
When acting on the legal warranty of conformity, the consumer:
benefits from a period of 2 (two) years from the delivery of the good to take action;
can choose between repair or replacement of the good, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
is exempt from providing proof of the existence of the conformity defect during the 24 (twenty-four) months following the delivery of the good. The legal warranty of conformity applies independently of any commercial warranty granted.
The consumer may decide to invoke the warranty against hidden defects of the sold item under Article 1641 of the Civil Code. In this case, they can choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
In any case, the online provision of the credit card number and the final validation of the order will serve as proof of the entire said order in accordance with the provisions of the law of March 13, 2000, and will constitute the enforceability of the amounts committed by the entry of the items listed on the order form.
This validation is equivalent to a signature and express acceptance of all operations carried out on the site. However, in the event of fraudulent use of their credit card, the customer is invited, upon noticing this use, to contact BASIL DKR by sending an email to contact@basildkr.com.
BASIL DKR is obliged to achieve results for all stages of order processing as well as for stages after the conclusion of the contract.
Thus, BASIL DKR undertakes to describe with the greatest accuracy the products sold on the BASIL DKR website. However, the responsibility of BASIL DKR could not be engaged in the case where the non-performance of its obligations would be attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by French jurisprudence. Similarly, BASIL DKR cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a service interruption, external intrusion, or the presence of computer viruses.
All elements of the BASIL DKR website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents.
The user who has a personal website and who wishes to place, for personal use, on their site a simple link directing to the homepage of the BASIL DKR site must obligatorily request authorization from BASIL DKR.
In any case, any link, even tacitly authorized, must be removed upon simple request from BASIL DKR.
In the event that any clause of this contract is null and void due to a change in legislation, regulation, or by a court decision, this shall in no way affect the validity and compliance with these terms and conditions of sale.
These conditions apply for the duration of the online services offered by BASIL DKR.
The archiving of order forms and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code.
These conditions are subject to French law. The competent court in case of dispute will be that of the defendant’s place of residence or, at the plaintiff’s choice, the place of actual delivery of the product.
